GENERAL CONDITIONS
The present general terms and conditions of sale apply to all purchases of products or services made on the online sales website of Dimanche www.dimanche.swiss via the online store. Specific conditions for the purchase of certain products or services are defined below.

Online product and service offers are only valid as long as they are visible on the site and within the limits of available stocks. The images appearing on the site are for illustrative purposes only and do not form part of the contractual conditions. The information contained in the catalogs and explanatory notes is given for information purposes only and does not constitute a contractual document.
Dimanche declines all responsibility for any errors or omissions in the drawings, images or diagrams in the said catalogs or notices.

PRICES
The prices indicated on the site are in Swiss francs. They are inclusive of all taxes (VAT) and include the advance recycling tax (ART). However, they do not include the shipping costs, which will be invoiced separately. Dimanche reserves the right to modify its prices at any time, but the prices invoiced to the customer for the products delivered are those in effect on the date of the order and which appear on the order confirmation. Moreover, promotional discounts offered within the framework of commercial actions on the site are deducted directly from the amount of the order.

CONCLUSION OF THE CONTRACT
The products and prices published in the online store constitute an offer. However, this is always subject to the (resolutive) condition that delivery is possible or that the price indicated is free of error.
The contract is concluded as soon as the customer places an order with Dimanche. The receipt of the order is confirmed to the customer by an automatically generated e-mail sent to the address provided by the customer. The automatically generated order confirmation e-mail does not constitute a guarantee of availability or delivery. It only indicates to the customer that Dimanche has received the order and that the contract has been concluded, provided that delivery is possible.

ORDER
An order only becomes final once it has been accepted by Dimanche. Sending an order implies the customer's acceptance of these general terms and conditions of sale in their entirety, to the exclusion of any other terms or conditions. Dimanche reserves the right to refuse a customer's order.

PAYMENT
The price invoiced is the price indicated on the order confirmation sent to the customer. Unless otherwise stipulated, all products and services* are payable by the following means: EuroCard/MasterCard, Visa, American Express, Paypal, ApplePay
All payment transactions are made in a secure area on the Shopify platform. The data recorded by Dimanche & Shopify constitute the proof of all transactions carried out between Dimanche and its customers. The data recorded by the payment system constitutes proof of the financial transactions. The credit card used for payment is debited at the time of the order.

DELIVERY TIME
The delivery times indicated on all order confirmations are indicative and apply as soon as the order confirmation is sent. Any request for cancellation of the order, and/or claim for compensation, for any type of delay in delivery on the part of Dimanche is excluded.

DELIVERY
The goods are delivered without assembly or unpacking.
The delivery of your order is free of charge in Switzerland from CHF 200 of purchase.
Below CHF 200.00 the cost of preparation and shipment of the goods depends on the order and the destination country. This amount is indicated in your basket at the time of payment.
If the order includes several items and the delivery times are different, Dimanche will send the order at once, when it is complete.
When the order includes one or more bulky packages, Dimanche reserves the right to adjust the delivery charges. Dimanche will then contact the customer to inform him or her of the delivery charges applicable to the order.
On request, it is also possible to personalize the delivery of an order.

EXCHANGES, RETURNS, WARRANTY CASES AND COMPLAINTS
Customer shall address claims for defective goods and/or services and returns directly to DIMANCHE by email at admin@dimanche.swiss and shall settle the details of the procedure with DIMANCHE. The existence of such complaints does not release the customer from his obligation to pay the invoice or the total value of the complaint. In the event of a return of purchased goods, the refund or cancellation will be made to the credit card or account indicated by the customer and made out to the customer's name, provided that the customer has paid the original invoice in full.

It is the customer's responsibility to check the goods upon delivery and to make any reservations and claims concerning possible defects or non-conformities. In general, items returned incomplete, damaged or soiled by the customer are not accepted. In the case of a return of goods, the shipping costs are at the charge of the customer.

RETURNS
Items returned within 14 days of their original shipping date, in like-new condition, will be eligible for a full refund or store credit. Refunds will be applied to the original form of payment used for the purchase. The customer is responsible for shipping costs on returns and shipping/handling costs on the original purchase are not refundable. All sale items are final purchases.

RETURN POLICY
In the event of dissatisfaction, merchandise may be returned and exchanged upon presentation of proof of payment. The goods must be returned in their original packaging, unused, clean, complete and undamaged. Damaged or soiled items will not be returned.
It is the customer's responsibility to check the goods immediately upon receipt and to report any defects or differences from the order. The legal provisions governing complaints (Art. 201 CO) apply.
Returns are possible within 7 calendar days after receipt. If the customer is not able to present a confirmation of receipt, the 7-day period is counted from the date of dispatch of the order.
In the case of a return of goods, the shipping costs are to be borne by the customer, who also bears the shipping risk. The goods must be returned by post. For a return by post, the goods must be sent to the following address Dimanche SA, return customer, Rue Micheli-Du-Crest, 2 1205 Geneva.
Refunds can only be made by the same means of payment as the original payment. Therefore, no cash refund will be made. After receiving the goods, Dimanche will check that they are in good condition and, if necessary, will decide on a refund, generally within 5 working days.

EXCLUSION OF THE RIGHT OF RETURN
All items covered with fabric/leather, made of wood species or ordered specially for the customer cannot be returned or exchanged. In addition, special finishes cannot be returned or exchanged. Items on sale are not returnable.

DEFAULT
In case of delivery of defective goods, the procedure is the same as for returns. The customer must inform Dimanche SA within 7 calendar days. The delivery note and the goods in their original packaging must be presented. The invoice with the product description serves as a warranty certificate. Exchange under warranty or repairs under warranty do not entail any extension of the original warranty period.

RESOLUTORY CLAUSE
Any total or partial non-performance by the customer of one of his obligations, as well as the non-observance of any payment due date, may lead, at Dimanche's discretion, either to the immediate payment of the sums still due on any grounds whatsoever, and the suspension of all deliveries, or to the cancellation of the contracts in progress.

APPLICABLE LAW / DISPUTES
This contract is subject to Swiss law, with exclusive jurisdiction in Geneva, subject to possible recourse to the federal court.
